2038, Adam Renaldi, New Zion ambassador to the crater.

Adam Renaldi is a quiet and reserved man and though always accessible to his colleagues at the Crater he rarely addresses the assembly. Today however, he approaches the podium briskly.

With a pleasant smile he speaks, "Fellow ambassadors and representatives, these are momentous days indeed. for myself and on behalf of the Defense League I would like to congratulate the Communidad Mediterraneo for their glorious achievement of trans-newtonian spaceflight. I would also like to pass on our congratulations and thanks to the intrepid crew of the Esperanza and her captain for their truly important and compelling discovery of the ruins on Mars.
"We also pass on our thanks to the Mediterraneo for sharing this information with all humankind.
"As others have stated before, more eloquently than I could, that the Sol system should be shared by all the Child of the Earth. We heartily endorse the proposed treaty idea and will support it's drafting and signing.
"Thank you."

With that he steps down and returns to his delegations area.

A statement by Harvey Briggs ambassador to the Chicxulub crater

This is a momentous occasion, for the first time mankind has traveled to a planet that is not our own.   
It is a credit to the crew of the Esperanza that they were the first of what we hope will be many explorers of this Trans-Newtonian age.   
I would like to take this opportunity to state that the Empire of New Canada wholeheartedly agrees that the solar system should belong to all humankind.   And we will support a treaty to that effect.   

However this bright day is not without it's shadows.   The ruins on mars show that the alien presence in our system is more extensive then previously thought.   That is why we are calling for discussion of a unified defense of earth.   We don't know what's out there, but we mustn't be caught off guard.

In early autumn of 2039, nearly a year after the transmission from the Esperanza, ambassador Masakiyo presents the Chicxulub embassies with the first draft of an international treaty to regulate ownership of stellar bodies in Sol.

Article 1
General obligations

Each Contracting Party undertakes never under any circumstances:

  • To declare a planet or moon as governmental property of their nation or to enforce, in any way, an inofficial state comparable to such;
  • To assist, encourage or induce, in any way, anyone to engage in any activity prohibited to a Contracting party under this treaty.


Article 2
Definitions

  • "Planet" means a celestial body orbiting a star or stellar remnant that is massive enough to be rounded by its own gravity, is not massive enough to cause thermonuclear fusion, and has cleared its neighbouring region of planetesimals.
  • "Moon" means a celestial body that orbits a planet and is of sufficient size not to be declared an asteroid.


Article 3
Exclusions

The Kuiper Belt and Outer Asteroid Belt1 are not protected by this Treaty.


Article 4
International cooperation and assistance

  • In fulfilling its obligations under this Treaty each Contracting Party has the right to seek and receive assistance, where feasible, from other Contracting Parties to the extent possible.
  • Each Contracting Party in a position to do so shall provide assistance for the ensured international status and security of any celestial bodies in the Sol System.
  • Each Contracting Party giving and receiving assistance under the provisions of this Article shall cooperate with a view to ensuring the full and prompt implementation of agreed assistance programs.


Article 5
Signature of the Treaty

This Treaty shall be open for signature until December 31, 2040, by any nation of Earth.


Article 6
Entry into force of the Treaty

This Treaty shall enter into force three months after 3 instruments of ratification or accession by nations have been deposited with the Chicxulub Embassies.


Article 7
No reservations to the Treaty

No reservation to this Treaty shall be admitted.


Article 8
Duration and withdrawal

  • This Treaty shall be of unlimited duration.
  • Each Contracting Party shall, in exercising its national sovereignty, have the right to withdraw from this Treaty. It shall give notice of such withdrawal to all other Contracting Parties in form of the Chicxulub Embassies. Such instrument of withdrawal shall include a full explanation of the reasons motivating this withdrawal.
  • Such withdrawal shall only take effect one year after the receipt of the instrument of withdrawal by the Chicxulub Embassies.
  • The withdrawal of a Contracting Party from this Treaty shall not in any way affect the duty of other nations to continue fulfilling the obligations assumed under any relevant rules of international law.

"The Japanese Alliance decided to pursue this matter urgently as all of humanity reaches for the stars and a conclusion previous to first diplomatic disputes would proof favourably for every nation's plans. We ask all nations of Earth to note, however, that this is but the first draft and intended to serve as the base for in-depth debates. We look forward to a lively contribution and hopefully soon ratification.
Due to the legitimate demur of New Canada we exempted all armament affairs from this draft. We believe that subject to be of comparable urgency, but also affiliated to a seperate debate and treaty."

1I have no idea how the outer asteroid belt Aurora puts into Sol is actually called.

OOC: I did some research into international treaties, but the matter is ... thick. To be honest, I think all I can write would be null and void before our modern international law. Hence, I 'just wrote something' that sounds good. Don't hold the treaty up to real international standards and take the wording for what it is. Please voice any questions concerning the comprehension in the Game Discussion thread - especially non-native English speakers but also everyone else.

[ooc]well, we aren't experts at high level international law or anything so I imagine this is reasonable, to be honest big agreements like this are more on the honor system than anything. I like the write up though[/ooc]

We of the Defense League approve the proposed treaty as it is currently constituted and thank the Japanese delegation for its diligence and perseverance in finalizing this draft.

On behalf of interested private and non-private interests we have reviewed the currently proposed treaty.

We have identified several areas of concern for our parties that have not been addressed in the currently proposed document.

I.
The document lacks any defined sanctions in the case of violation or infraction, by any signing or non-signing parties.
If sanctions are to be imposed, whether they are to be economic, commercial, intellectual, or military.
Obligations of signature members in the event of such an occurence.

This could lead to an inability to enforce, or could in worst case circumstances be used as justification for enforcement through destructive means.

I.A.  Obligation of signature members in the event of nonsignature members attempts to intentionally abridge or violate any or all signature members rights under said treaty.


II.
In light of the known existance of alien structures on at least one body covered by the treaty.

II.A..  Ownership or rights to use of any intellectual or physical property reclaimed from said installations are not addressed.

II.A.1.Ownership of intellectual property recovered and rights of the salvor.
If the salvor has sole rights to said property.
If the intellectual property is to be dispersed among all signing entities.
If the intellectual property is unrestricted and will require unrestricted distribution.

Of note:
The open transmission of the
Esperanza
could be used to set precedent in this case and could become the focus of future litigation.

II.A.2.  Ownership of any physcal property recovered and rights of the salvor.
If the salvor has sole rights to said property and value derived there of.
If the physical property is to be dispersed among all signing entities, or due compensation provided if such is not possible.
If the physical property is unrestricted and will require open access if possible.

II.B. Hazards incurred, indemnity, and 'reasonable prudence'.

In light of the known dangers present in the aftermath of the 'Invader' and the 'Chicxulub Incident'.

II.B.1.  Requirements for 'reasonable prudence' to be employed in the investigation or salvage operations amongst alien structures, and what this constitutes.
II.B.2.  Indemnity to third parties damaged if the actions of a signature party or non-signature party salvor result in destruction of property or loss of life to any third party.

(Our non-private interests represented feel concern with the current stance of certain 'Southern European' governments, and that an incident instigated by a signature party which resulted in another 'incident' which directly caused damage to the 'Southern European' governments property or personnel could result directly in hostilities to all signature members of the treaty.)

III.  Exclusion of the Earth to allow the continued sovreignty of existing governments.

"In the name of Her Majesty, Queen Louise the First of the Northern Kingdom, I, Ambassador Lord Thomas of Ashford, 1st Baron of Ashford, will speak to you today.

Our glorious Northern Kingdom has taken some time to consider the proposed first draft of the International SolSpace Treaty and while we want this treaty to come to life, Her Majesty, Queen Louise the First, feels that there are a few issues preventing us from signing it at this moment.

Although we are unaware of the intentions of the W., W., & Sons Legal Consultation Firm or if and who contracted them, but the points they made are valid.

We would also like to note that all celestial bodies smaller than moons are completely left out of the treaty. This would mean that everyone could claim complete ownership of all celestial bodies of this kind, this would most likely include asteroids. This would exclude all nations except one of ownership and access of resources on said celestial bodies. This would mean that the first or fastest nation to claim said ownership would have all rights concerning these bodies. With the varying progress in space programs amongst the nations of earth, we feel that this issue has to be addressed, to avoid nations ending up with no access to valuable resources.

A statement by Emperor Gregor

Earlier today I  received a letter from the Japanese Prime Minister, asking me to apologize for the espionage team found operating in her country.   I'm afraid I cannot do that. 
Nations have spied on each other since before there were nations.   Even friends keep their eyes open, to make sure they really are friends.   Espionage is a part of the "game" of international politics.   And I will not pretend to be sorry when I'm caught. 

I do however wish to express my deepest regret for the injuries and property damage caused during the attempted arrest.    It was never my intent that my agents should make some stupid last stand.   The Japanese were our friends, and I hope that they will remain so.   

 I would also like to apologize for the behavior of my embassy staff.   It was completely  inappropriate, and those involved have been recalled to face disciplinary action.   

It is my sincere desire that this tragedy will not affect our relationship in the future.

    "Honourable ambassadors from fellow nations of Earth, today I step before you because of several pressing topics.

    At first, we must welcome the People's Socialist Canton Republic back onto the surface of our planet. We do not wish to overshadow the emergence of a new state, but we will wait for them to make a public announcement towards the Chicxulub embassies and yet have other, urgent matters to adress:

    To start with the more pleasent progress, the Japanese Alliance can present a new draft of the International SolSpace Treaty, In its writing we did heed the commentary given by the Northern Kingdom and W., W., & Sons Legal Consultation Firm, of which both offered valuable intellectual input for this debate. The Japanese Alliance deems it necessary to annotate that within the current draft no active repercussions are intended for non-signing states, but that the various benefits extend only to those nations that sign the treaty - namely the sharing of ruin technology and security offered for any civilian or military operations beyond the tradional earthern borders - and that any blockade by even non-signing nations will be acted upon in accordance with the treaty to ensure its validity.
    If however the general opinion is to inclose active repercussions and the necessary will to enforce such is present with the potentially signing nations we still urge these people to voice any ideas and concerns."

    Every Contractin Party is entitled to establish military presences within the Sol system, but has to respect the international neutrality of celestial bodies and consider the security of civilian populations and installations. No large military bases may be eracted on the same body as a sufficiently large multicultural civilian presence and the colonisation after the establishment of a large military presence is reason enough to force a relocation of the military base.


    Article 2

    • To declare a planet, moon or asteroid as sole and governmental property of their nation or to enforce, in any way, an inofficial state comparable to such;

    Furthermore the Contracting Parties are obligated to:

    • Protect the international neutrality and freedom of each celestial body within the Sol system.
    • Assist in any defensive maneuvers to ensure the continued freedom and security of any celestial body within the Sol system in accordance with Article 6.
    • Respect the established military bases and civilian presences of other Contracting Parties, keeping safe distances with own military units unless sufficient reason for an approach is given or an invitation is sent by the initial Contracting Party.
    • Identify their vessels upon flight within the Sol system whether it is a civilian or military ship.


    Article 3
    Handling of extra-terrestial remnants within Sol

    As the Sol system is the crip of the entire human race the ruins located on Mars as well as any further abandoned extra-terrestial presence are regarded as the communital property of all Contracting Parties. As physical remnants are unique and undistributable the handling of intellectual and physical salvage has to be distinguished:

    • All finds within Sol have to be disclosed to the general public to ensure a fair handling of this matter and neutral observers from other Contracting Parties should be allowed to inspect salvage operations.
    • Installations salvaged from an alien ruin within Sol are the property of the salvaging Contracting Party. As information about what can and cannot be salvaged is lacking no fixed compensation can be assigned however. Exceptional finds are open for debate among the Contracting Parties whether a compensation needs to be made or not.
    • Intellectual finds in form of technology can and must be distributed among the Contracting Parties.


    Article 4
    Invader activities on celestial bodies within Sol

    Should any remnants within Sol hold dormant or active Invader units within vaults or on the body's surface the celestial body is considered a war zone.

    • The Contracting Parties are obliged to cooperate and exterminate the alien presence as national capabilities allow.
    • Civilians are to be evacuated or otherwise safeguarded from harm from any Invader force by mutual military efforts of all present Contracting Parties.
    • Collateral damage is to be expected in a war zone and no reparations can be made unless the cause and victims can be seperated and clearly identified, in which case any loss of property needs to be replaced or otherwise compensated.



    Article 5
    Definitions

    • "Large" military bases mean a military presence exceeding the absolute neccessary size to ensure the safety of local civilian settlements under peaceful expectations.
    • "Large" civilian presences are any multicultural civilian presence on a celestial body exceeding the 100 million population mark.
    • "Sufficient reason" is only necessary for the approach of military vessels onto large civilian presences or celestial bodies solely hosting a military presence from another country. The ensured freedom and neutrality of all celestial bodies within the Sol system explicitly allows the approach of any planet, moon or asteroid by civilian vessels without any given reason.


    Article 6

Our two grand nations are willing to cooperate on a large scale and aide each other in times of need. For the time being no further information will be disclosed, but with current developements both our nations regarded it as necessary to publicly announce the support we offer oneanother."

    The Japanese ambassador hesitates a moment befor proceeding in his speech.

    "A much less positive form of progress is the incident between New Canada and the Japanese Alliance. As Emperor Gregor I deemed it necessary to release the details into public and turn it into a debate, so will the Japanese Alliance.
    It is true that Japanese Alliance agents found evidence of Canadian "civilians" operating on Japanese territory for espionage purposes. Investigations turned up their intention to unreveal highly classified governmental information which apparently was collected to further the "security" of New Canada, as honourable Emperor Gregor I announced previously.

    The Japanese Alliance takes his inabillity to apologise as quite the strain on international relationships between our two nations. However, as New Canada's most respected Emperor Gregor I, too, announced he doesn't trust the Japanese Alliance anyway, and according to his own words, doesn't trust any other allies he might have. In our opinion, this is both a very poor choice of words as much as an open announcement to conduct unprovoked espionage operations on both allied and neutral nations alike. That the entire team of operatives decided to rather die during arrest than face an open and fair trial and interrogation, the standards by which New Canada operates seem questionable at best.

    We, the Japanese Alliance, see no other way than to further expect a now public apology by most respected and honourable Emperor Gregor I of New Canada to show that his words did, in fact, not mean the inhospitaility they seem to pronounce.

    The Japanese Alliance does not spy on other nations. Our intelligency agency operates solely on Japanese territory. We trust our allies. And we do hope that this can be the standard by which modern and civilised nations operate."[/list]

    Ambassador Kuan-Yin Lin step forward to the podium. Unlike westernise diplomats that tended to send old women Lin was relatively young in her mid 30's, but her English was impeccable as well as her appearance.

    "The People Socialist Canton Republic thanks you for your hospitality. There is much work to do in the PSCR to make it the proud nation it was in the past. The Chinese people have always respected other nations sovereignty, and our history is not one of conquest. But built on trade and and mutual respect. We look forward to working with all of you in this environment.

    As for Cantons internal and external policy this is a matter for the chinese people, no interference will be tolerated.

    Thank you for allowing me to speak"

    Her presentation was formally concluded she step away and mingled amongst her own people again

    I must apologize if my words seemed inhospitable. Diplomacy does not come naturally to me. 

    New Canada has never tried to hide the fact that we have spies, and with Japan's letter I thought I should make our position clear. In hindsight I see this was a mistake. I should have dealt with this privately and only then have made a public statement. I'm sorry for the turmoil this has caused. 

    I realize now the gap between our views on espionage.  I have never seen simple spying as a hostile act. While we take steps to prevent foreign agents from operating within our borders, we sent our spies and expected other nations to do the same. 

    The Japanese on the other hand have a less tolerant view. 
    I apologize, it was never my intention to jeopardize our friendship. 
    I have ordered a halt to all foreign operations while I reconsider our policy. 

    As for the death of my team, they were never given orders to commit any act of violence. While I understand their desire to avoid capture, when they opened fire that was a hostile act that I do not condone. 

    On a more pleasant subject. 
    I to would like to extend my welcome to the newest trans-newtonian nations, the PSCR and the NDR. It is good to see order returning to the world. 

    I'm also pleased by the continued development of the Solspace Treaty. I strongly agree that all humanity should work together to destroy any Invaders we may find. 

    Once again I apologize for the controversy we have caused, and ask the forgiveness of Japan and the other nations of the world.

As some nations may think that after the great invasion international laws no longer 'count', the NDR has decided to regard any military help towards the coalition as a provocation towards us, and all other peaceful nations on Earth.'

     A Lyzander class drop ship sets down at the Chicxulub landing center.    Several soldiers wearing ebony colored armor with golden highlights.    Their faces are completed covered by blast shields and dark visors.    Once the area is secure two more soldiers descend the ramp ahead of a figure with red combat armor instead of ebony.    While the guards are armed the figure is not.    With two more flanking guards the person heads into the antechamber.   

     The person, obviously of some rank, ascends the steps and quietly looks around at the reaction that their entrance has made.    Removing the helmet and placing it upon the podium, the figure now identified as female speaks.    "People of earth, I have been ordered to report here and brief you on the current situation and to give you a warning.   " She moves a few strands of dark brown hair from her eyes, "I am High Admiral Daala of Shadowveil, we have risen from the ashes of the invasion and will not allow such a thing to occur again.   "

     She looks around at the assembled people, ambassadors and important national officials of important nations.    "Secondly, I also present you a warning.   Our lands are closed to those of other counties, no one may enter without prior authorization.    Anyone discovered within our claimed lands will be terminated until further notice.    The land is not peaceful.    Heed the warning at your own choice.    We will have more to say at a later date.   "

     After delivering her messages, she picks up her helmet, smartly and gracefully turns and leaves.    The four guards escort her out of the building and not to the transport like those might suspect, but to a relitively clear area.  It appears the command tent will be setup here and construction of an embassy will take place. 

     Over the next several days supplies and personnel are delivered and the quick prefab construction of an embassy, more like the beginnings of a small fortress, begins.  Things are raised quickly and within a few months a new building and a well defended one is setup.

     (Yes, only slightly militaristic :P)
